Amalgamation of RRBs-compliance to
provisions of sub section (3)(b) of section23(a) of RRBs Act 1976.
As
per Gazette notification dt.12.09.2005 three RRBs of Punjab, sponsored by Punjab
National bank have been amalgamated into
a new entity i.e Punjab Gramin bank.
In this connection, we advise that as per section 23A(3)(b) of RRB Act,1976 upon
amalgamation of RRBs if an employee of the transferor RRBs is not willing to
become an employee of transferee RRB can give a notice in writing before the
expiry of three months following the date on which amalgamation takes effect and
the payment of gratuity, PF and other retirement benefits admissible under rules
of the concerned transferor RRB to such an employee should be made before that
date. This may be brought to the notice of staff of erstwhile RRB as under:
“Notwithstanding
anything contained in clause(a),where any of the employees of the transferor
regional Rural Bank not being workmen within the meaning of the Industrial
Dispute Act,1947 are specifically mentioned in the notification, or where any
employee of the transferor Regional Rural Bank has by notice in writing given to
the transferee Regional Rural Bank at any time before the expiry of a period of
3 months next falling the date on which the amalgamation takes effect intimated
his intention of not becoming an employee of the transferee Regional Rural bank
the payment to such employee of compensation, if any, to which he is entitled
under the Industrial Dispute Act,1947, and such gratuity Provident Fund and
other retirement benefits ordinarily admissible to him under the rules or
authorization of the concerned transferor Regional Rural Bank immediately before
that date.”
